Further Application Forms for Probate

Following on from last week’s blog related to the new application form for Probate, this is just a short note to let practitioners know that the probate office has also now launched a similar set of application forms that must be used in probate for other cases namely

  • Intestacy
  • Will Annexed
  • De Bonis Non

These are very helpful in submitting applications and while it doesn’t take away the need to understand the core principles or where to find the law, it is a fairly comprehensive checklist of everything that you should need or should consider in relation to making these applications. This should surely reduce the error rate.

To take one example; on the intestacy form, there is a prompt to include a reminder to include supporting market value information. The form then brings one to the notes section which explains the circumstances where one needs to submit a supporting valuation (ie in particular where the death is greater than 2 years). These types of prompts are really invaluable in submissions to the probate office and will be of great assistance to practitioners.

This is a very welcome development which will hopefully streamline probate for all of us and bring down the time periods when it comes to probate applications (particularly in Dublin).
