New Solicitor form for Probate

This is just a quick note to say that the probate office have launched a new Notice of Application form, called “Probate Application Form – Executor Applying”. Some of the information on the existing Notice of Application must be in the new form, to include name of deceased and date of death. The new application form does not require one to place the PPS of the deceased on the form.

The new application form is relatively straight forward and contains helpful notes for solicitors for reminders on some of the items required. The new form must bear the stamp duty/court fees, as is the case with the existing Notice of Application form. (This appears to be only a Principal Probate Office requirement and local offices appear to accept cheques or fee sheets in addition to the Notice of Application Form).

The form also contains a checklist of items required to be considered by the solicitor prior to lodgment. The checklist contains items all of which will be familiar to the probate practitioner. Nonetheless it is a useful checklist and helpful guide in relation to submission of applications.

It appears to be the case that the new form can be used now and its clear from a notice published on the probate office website that the existing form Notice of Application is being phased out and will not be accepted after the 18th of October of 2024.
